My employer was trying to deny my aspergers is a disability in an employment tribunal. The tribunal dismissed this argument and my employer now accepts that this is a disability.
They are now keen to settle.
Its not over yet but it just goes to show that even if an employer doesn't take aspergers seriously....an employment tribunal judge will.
Well done for standing your ground and sticking up for your rights! So pleased the outcome has been positive - it's tough to take on an employer like this especially when you have to represent yourself. A former colleague of mine has a full Employment Tribunal hearing scheduled later this year, having been discriminated against as an autistic person. Let's hope employers start to take their responsibilities seriously.
I think more of these cases need to have a full hearing to give these cases the publicity that they need. I think then you would start to see real change.
A bit of understanding and tolerance is needed by employers. This isn't asking for the earth.
Fantastic news! Well done! This is great to know in case I take the leap to sue my previous employer. It's great to know that Aspies have a fighting chance! I'm delighted. This has made my night :)
Good to hear. Proactive stuff. What did your employer expect? Well the more legal precendence that this stuff gets the less people will have to go through the battle you have. Thanks, and congratulations.
Just registered to say I read your earlier thread(s), and I'm glad you won despite the naysayers. I've disclosed my diagnosis to my employer a fortnight ago, and the response has been awful. This gives me more courage to see the process through. I hope you get what you deserve.
Also tribunal outcomes are published. Could you link to yours? I understand if you want to keep it private.
congratulations! I have a horrible feeling I am going to have to go through this. Well done although you must be feeling totally exhausted! My employers are treating me pretty much the same way.
That’s excellent. Well done :)
Nice one - well done! :)
If they settle no doubt there will be a non-disclosure element to it. If they dont however; i will take this all the way and give it the publicity it deserves. I know precedents in law are sorely needed by us as a community.
They have said they wish to settle but we will see what happens on the 8th-9th Feb
