Autism, and anti social behaviour.

A few weeks ago we have had a letter from our landlord about complaints of anti social behaviour from our neighbours. The complaints were regarding noise nuisance. We have 3 children, 9yrs, 5yrs, 3yrs, and they are all boys. Our 5 year old son was diagnosed with ASD, and global development delay 2 years ago. Our neighbours were claiming that we were banging on walls, slamming doors. Theses claims are a total lie, we have never done what they were claiming. The landlord (housing association) did there investigation, and we started mediation with next door. All the sudden the plot changed to our children being noisy. Now I understand that there is what would be considered general household noise, and the noise that children make is included in this. I think the real issue here is our autistic 5 year old who can be very rowdy sometimes, and he will sometimes wake up in the early hours. (4am+) My question is would his behaviour be classed as anti social behaviour if he was having a bad day as some autistic children do?

Any advice would be welcomed.

  • During lockdown I lost my home & was threatened with an ASBO unless I moved or cured my autism because my neighbor was abusing me.  I was the only person he abused, I believe he's a psychopaths based on his behavior.  He'd scream at me every time he saw me threaten to beat me up & rape me.  During lockdown when I was isolated with him he got worse & wouldn't let me leave my home to even go to the shop to get food or fresh air & sunshine.  It broke me & I offered him £3000 to leave me alone.  MY landlord & the police had a meeting where they decided that I my neighbor wouldn't have abused me if I wasn't autistic, so I was to blame.  My landlord called lifeworks the charity I was under and told them that he takes care of all my daily needs and I being violent.  My landlords never taken care of any of my needs, I paid my rent via my bank account & only saw him about 3 or 4 times in the 20 years I loved there, but lifeworks wouldn't believe me so my care and support was dropped & my landlord told me that I had to move, cure my autism or get an asbo as landlords have the right to give ASBOs.  When I told him autism was curable he went ballistic & shouted at me about how discusting autism is & how it's a choice.   

    Not only are you more likely to get an ASBO if you're autistic, you can get one just for being autistic if you're being abused.        

  • There is so much that is legally incorrect here that it makes my head spin. Either you’ve badly misunderstood the situation or the police and authorities have badly ignored the law. I’d be willing to guess it’s both. Either way I’d go see a lawyer and see if you can get legal aid to have this looked at. Judicial review maybe or challenging the asbo.
