Needing to prove a diagonis

Hello

my sons employers are asking him for a letter from his GP on his diagnosis

should they be able to ask for this or is it discrimation

  • Hi Vikki - welcome to the community.

We're not allowed to offer legal advice to each other in this community.

However, there's lots of useful information around this subject here, and I suggest reading these resources first:

    ACAS - Getting a doctor's report about a worker's health

    NAS - Employment - includes:

    • What support can I get at work as an autistic person?
    • What are reasonable adjustments and when can they be requested?
    • Deciding whether to tell employers you are autistic
    • What can I do if I'm having trouble at work?

If you then still have questions, I'd suggest calling the ACAS helpline for confidential and free advice:

    ACAS - Helpline

  • His employer can ask - but you have no legal duty to consent

you (or in this case your son) control who and what you disclose

He didnt even have to disclose his Autism

You don't even need a diagnosis to request reasonable adjustments either

  • They may be able to argue its for HR purposes so that they can adjust internal process to take account of any adjustments. If they have an occupational health service then I would provide to a doctor / nurse.

The law says that you do not need have a diagnosis to get adjustments. However, if they refuse reasonable adjustments then you would need to prove this at tribunal. I think it wrong to ask for this but can understand why.

I would ask them why they want this and for what purpose before making rash decisions about discrimination.
