help with the education system

In September 2014 my son started year 7 and he receivesno support from his school dispite him having a diagnoses.  The school have him labelled as disruptive and rude and he is constantly in detention or internal exclusion because of this.  He has recently been removed from his maths tuition as he is clashing with another boy.  

On Wednesday the 21st October I gave the SEN deputy a form to fill in as he has been referred back the peaditrician due to the fact I think he is ADHD I was told the form would be filled out and would be sent back to me in the post straight away we also discussed the Surrey pathway and I was told it would be filled in accordingly as they feel it's the route to now go down. ( I have been saying he needs a statement since September). On Thursday the 28th I had a reveiw at the school where James behaviour was once again brought up I mentioned the form that I was supposed to receive back in the post and his deputy head of year was meant to chase it up and contact me yesterday.  I never recieved this phone call and I feel they are holding him up by not getting the relevant paper work filled out as this is preventing a correct diagnoses and stopping him getting the help he needs.  I feel like he is being failed by the education system and I have no where else to turn to and dont know what to do and im just looking for some advice on people who may have been threw something simular.

      Few people realize that you can apply for an assessment of your childs needs yourself. Unless the system has changed dramatically since the EHC Pans were introduced that is. This link is from IPSEA and provides a model letter that will allow you to apply yourself to the LA, using the specific jargon necessary to move things forward correctly.

    IPSEA are a real help here. The information they supply helps guide parents through the process, when a School/College either isn't able to help or refuses to refer.

    Keep all copies of e-mails etc and ensure all correspondance is kept in your own specific file. Should the LA refuse to assess, you will need to go to Tribunal and appeal their decsion.

    The Schools refusal to act on a parents concerns, in a timely manner, can be constrewed is neglegent, at best.

    Seems from what you say, you have already exhausted your efforts in talking to the School and now is the time to act. EHC/(Statement if it's still operational in your area) takes some time to conclude. So the longer you leave it, the later it will be for your child to recieve the correct intervention. If the LA do refuse to assess (and some do) this will delay things further, so time is of the essence. You can continue to have assessments by specialists whilst your request is ongoing. Indeed, the weight of evidence you have, may help sharpen your LA's focus. (Keep in mind that private assessments can also be sort if you wish and submitted by yourself if the LA refuse to do a specific assessment you require or that you feel is necessary. They do cost however.)

    Pull together all the assessments already done on you son and any diagnosis reports already made. Place copies of these in a file ready to write a statement on why you feel your child needs an assessment. IPSEA should be able to help you here.

    My son's assessment started in the last year of primary and due to a particularly poor LA. he didn't receive a statement untill year 2 of his secondary education. Much intervention time lost and a real injustice to the child. Hopefully your LA in Surrey will be a lot more approachable. 

    If you need any more info just call IPSEA. You will be on hold for a while, but the support is generally worth it.
