What's the law

I'm new to the site and this is my 1st post. I am James' Mummy. James is 2 yrs 9 months and was diagnosed with ASD in Jan 2011. James was also born with a bilateral cleft lip and palate (now repaired through 2 surgeries in his 1st year). It is difficult to say how severe james' ASD is as he is so young, however, he doesn't talk at all, I find it difficult to keep his attention for more that 2-5 mins and he is not yet potty trained. I could say much more about his ASD but I hope this enough info to answer my specific questions..............

I have a question about the law and also some advice on how I should treat an issue.

James attends a private nursery 9-3 Mon, Tue wed, they are great with James (he loves it at this nursery) they are really willing to get involved and we have 4 weekly meetings about James' development they are starting PECS and storey boards with James too. The issue is about 1-2-1 funding as it is a private nursery and prep school up to the age of 8, the school are saying they will try but are unlikey to be able to get free 1-2-1 tuition for him as it is a private school. As I am a single parent I cannot afford private 1-2-1 tuition for James, it is tough enough paying the fees as they are but I am happy to do so because the nursey are so good and understanding with James.

Because of the issues of 1-2-1 funding, I have recently enrolled James at a nursery affiliated with a state school for just 2 hrs a week on a thursday afternoon; this nursery have been really good about pushing 1-2-1 support for James, the issue is that as it is a pre-school nursery they have no nappy changing facilities as such they call me and ask me to go in and change James' nappy if he has done a poo. As a parent I feel humiliated every time they call me to go in (I know it's only once a week for 2 hrs at this nursery, but James is regular so it is every week!). On top of this the other children will start noticing, I am sure it cannot be good for James' self esteem.

My 2 questions are:

What provisions do nurseries/schools need to make for ASD children regarding nappy changing?

Can private nurserys/schools successfully gain support for 1-2-1 support (free)?

I would really appreciate some advice as I want to do the best thing possible for James as this critical stage.

  • Prior to school age it is exceptionally difficult to get a 1:1 support worker. The only thing i could suggest is if you are willing to move him then some special needs school offer nursery placements for children with additional needs (my son's school goes from nursery till the end of college). The staff to child ratio is generally better and they have the training and expertise.
