Son out of school for 16 weeks single working parent feel only option to resign but can’t afford it. Any advice?

My son year 4 with an EHCP has been out of school for 16 weeks. His current school are very supportive but have said that they can’t not meet his need at his last EHCP review. The LA have the paperwork and the info on the school we would like him to go to. The LA are in special measures and I still have no date for his case to be heard at panel. I’ve lots of support around this as this is  as my oldest son was out of school for a year whilst I fought the same LA for an appropriate placement for him.

I am a single working parent.and do need to work. I access all the state support I can DLA for my boys, tax credits etc. However although my employer, ironically the same LA have been supportive they can’t keep being flexible. I’m unable to plan for anything as I have no answer re change of placement or alternative education being offered!

I just don’t know what to do? Any been in a similar situation where there job has been at risk due to the unethical and illegal behaviour of the LA

  • Have you taken legal advice?  The NAS advice line, Children's Legal Centre or Coram Legal might be able to assist. The threat of a complaint to Ofsted / SENDIST might persuade the SEN department to act. Of course, if the LA is in special measures they may be in such a mess that another complaint or legal case will just be added to the pile ...

    Contact your trades union - they might be able to provide legal advice. Complain to your councillor and your MP, especially If the MP is a different party to that in power in your council.
