DLA rejected for 12 Yr old son

Hi.

My son has moderate learning difficulty and waiting for his autism diagnosis from last year I applied for Disability living allowance but was refused.He has eczema and very bad acne on face and body along with behaviour problem I explained everything in form but stills get rejected. He is being bullied outside school so I have to pick and drop him myself.can someone help me what to.do?I have been told by Gp and school that it might take 3 years to get diagnosed because of our area where we lived there is long queue. I don't have any medical evidence to support my appeal. But without public funds I am struggling to meet his needs.

  • First of all you need to request a mandatory reconsideration. Next you'll need to find some organisation to help you fill out any of the complicated documentation in such a way that the decision maker cannot mis interpret. Citizens advice and signpost you a organisation in your area.  

    You need formal evidence but it doesn't have to be a formal diagnosis. If you are waiting on a diagnosis then you will need medical evidence. This can be obtained by requesting a doctors letter. The letter must contain explanation of the absurd waiting list and the time suspected time of being assessed in which this case is three years. The doctor must also make it clear that they heavily believe that your child has autism spectrum and support it with clinical evidence referencing the 'Diagnostic and Statistical Manual of Mental Disorders' in a way this is not open to interpretation. (Caution most doctors surgery charge for doctors letter and can range between £30 and £80)

    School related evidence can be used as behavioural evidence, school reports of bad behaviour and a formally written letters by multiple teachers may provide such evidence. This letters must contain at least one behavioural event that occured in front on the teacher writing the letter along with a written testimony that they believe that behaviour is influence by either medical condition, learning disability or nuerodevelopmental disorder. 

    Any paperwork from mental health team, General practitioners and social workers or support workers will all provide secondary evidence towards your claim.

    you'll will also require photocopies of all formal diagnosis already given and lists of medications currently taken, what has been tired and the effects of such medications. Treatments given such as anger management and therapy and document proving that your child attended will also work in your favour.
