No Breaks

Hi all I'm new here and would appreciate any advice.

My daughter is in year 3 (age 7). She is diagnosed with ASD. School are not allowing her outside at break times anymore. She has to stay inside to complete work. She's stuck in the building from 8:15 to 3PM. EP and OT believe she isn't completing work due to her needs not being met including sensory needs. School still feel she should be punished as her hiding under a table is choice. Is this legal? Her behaviour is deteriorating along with her MH. School refusal is getting worse and the meltdowns at home time. EP has recommended an ehcp for additional support but this will take months. I would take her home for dinner time but I doubt she'd go back without a fight. I don't know what to do. Any advice appreciated
