EHCP Annual Review

I do not know what to think about it but a year ago my son had his EHCP Annual Review and we have not received any documentation since that time. What we have is his Final EHCP dated on January 2018. I keep asking the LA for a copy of our son's updated EHCP, but they say that they are still working on it. One year passed and we know nothing. Someone told me that maybe school could help us with the copy of a document but when I asked them for that, they sent us the Proposed EHCP. The school said that this is one and only document they have. As far as I know it is not a formal document so I wonder how the school can rely on it? I assume there is a difference between a proposed plan and its final version... We are bad at arguing but this time we think we have to take action because we feel that we are not informed well and some institutions just ignore us. I was fighting for an OT therapy and after a couple of months (in July last year) our son was successfully assessed by the specialist. The headteacher of the Base said that the EHCP does not have to be updated every year but in terms of new provision, agreeded by the panel, we think the plan should be amended. Are we right? The headteacher said that the information about our son's OT provision will be added next month after his second annual review. To be honest, we are confused now. Why it takes so much time? What do you think about this? Do you think we panic too much? I would be grateful for your ideas.

  • Hi, it is definitely not right. The Local Authority should have issued you with the proposed EHCP within certain number of weeks from the annual review and with the final EHCP a few weeks later. The EHCP should capture all the needs and provisions for each of the identified need. 
    It would help you to get a copy of the SEN Code of Practice and get yourself familiar with the technicalities of the process. Unfortunately help at school  for autistic children comes with a continuous struggle from the parents. You will need to know the code to follow up and hold the school and LA to account.

  • Thank you so much. The headteacher of the Base said that my son's EHCP will be updated when his transition will take place. This is still strange to me. Children change quickly and what is the point of keeping a document with information that is not relevant to child's current situation. It is going to be tough time for me.. I want my son to get support he deserves and I also want to have documentation as a proof of the provision he receives. As a parent I have all rights to ask for that, don't I? 

  • Absolutely, talk to the helplines and get your ducks in the raw. Be careful that at the transition  they would not dilute the EHCP with unenforceable language.
    Try SOSSEN walk in centres if you can. They would speak to you in person and look at your documents. Good luck..
