Disbaility Discrimination Claim

Just wondered if anyone has any experience of tackling a Disability Discrimination claim against my son's on their own?
I have had some free expert advice which felt there is a case to answer against my sons' schoo ( he's not going back there!), but wants to point me towards a solicitor if I can  get Legal Aid ( not sure yet if I would !), or a charity to take it up on my behalf. My intention when seeking advice was always to pursue it myself, so I wondered if anyone else has done this, or if I'm totally mad!! I thought the whole point of SENDIST was it didn't have to invlove expensive lawyers!

  • I sent a 3 A4 page letter (typed!!) to the head and got a 4 line reply to say he had investigated and could find no one who recognised any of what I said, and the staff are upset because 'some' worked hard to give support! My letter acknowledged that 'some' did!

    I am following the school's complaints procedure to the letter! The head took longer than it allowed to reply and I had then sent a further letter to the chair of governors. If I am unhappy with his answer I can take it to a governors panel, then to SENDIST. My letter to the Chair of Gov spelles out that I feel I have a case and WILL take it further unless I get some satisfactory answers.

    To BTCCfansmum I would say get the school's complaints procedure and follow it! That way you have done what is required before you go elsewhere, eg SENDIST. If you involve individual gov too soon they may be unable to take part in any gov panel to discuss it, and you may need the SEN gov on 'your' side!

  • Im just considering doing the same as my son is going through statementing and I'm waiting for the final copy. I've requested a move of school as the current school cannot cope and the way they do is by excluding him. He was excluded during lunchtime all last week as they dont have anyone who can support him during the lunch hour and the Friday before he went into a meltdown hurting another child. I have now written to the SEN Governer and I'm going to provide them with information about Autism as the school is absolutely clueless. What made me more mad is that I subsequently have found out another 4 Autistic/Autistic Spectrum children were also internally excluded or sent home last week. Im not sure if this is appease the other parents or because they dont have the staff.
