Does anyone know if there is costs involved for me to take my local authority to tribunal to get my son with Autism and ADHD into the right school?
Thanks
Just posing the question, the person who is the subject of the appeal If they have limited funds in the bank I believe it may be under 3000k may be entitled to a solicitor advice using legal aid. I am a responsible parent for my autistic son who is aged 35, while I deal with his affairs It is only his income and savings that is relevant. Whether it is the same for a minor, on who's behalf your are acting? It seems a little unfair not to have some State input into solving a problem made by the State.
We’re going through an appeal at the moment. We have a specialist solicitor. It’s costung £8k for the expert witness reports and around £10 for the solicitor. If it settles before tribunal. If it doesn’t we’ll have to pay more legal costs and also pay the experts to appear again. The assessments and reports are expensive once you add travelling costs etc. The cost is keeping me awake at night but I dint feel confident enough to do it myself. It’s s complex case with mixed funding involved.
Thanks for responding.
Thank you. Thats one thing less to worry about as Im already expecting a huge battle.
There's no cost for Tribunal only if you want to get your own private reports to support it.
I know they banned fees for employment tribunals last year. I think they decided it was unconstitutional. That would imply that fees for other types of tribunals would have been revoked as well, but I could be wrong.
The information is most likely available on the tribunal's website.
Thank you for replying and for the information. I will look into it. X
I'm replying even though I don't know. I don't even know if people usually represent themselves at tribunals.
Have you tried the NAS Education Rights Service 0808 800 4102 ?
There are also a bunch of other advice lines here that may be relevant:
