SENDIST Tribunal !!!!!!!

Hi

I am new to the site. I have an 11 year old son with a diagnosis of Aspergers Syndrome, complex learning needs, fine motor skills difficulties, speech and language and sensory issues.

We are currently in the process of a SENDIST Tribunal as we have made a claim against his previous school of discrimination against a disability. Concerning a residential trip that he attended and was excluded from excursions less than 24 hours into the trip and then sent home for being excited and tired.

Following investigation into the care plan put together with no involvement from us  , despite asking for one to be set up over and over. We feel that they discriminated against him by not making reasonable adjustments.

The paperwork from us and the governing body will be looked at by a judge and then if all is well we will attend a hearing in a few months.

We have not involved a solicitor due to finances. They have one representing them. I am after advice on accessing legal representation or just simply any response of anyones personal experiences with SENDIST.

Thanks

  • Hi MummaWilson,

I'm in a similar position. Awaiting hearing in September. Similar to yourself, exclusion from trips and failure to make reasonable adjustments. If we as parents don't challenge discrimination things will never change. I think too best starting point is speaking to education rights on here. I wish you the best luck x

  • Hello MummaWilson

Here's a link to the Education Rights Service which Hellsbells suggested:

Have a look, I'm sure they'd be able to offer you some advice.

    Good luck with it all.

  • Hi there.

I don't know what SENDIST is, but I do know that we got lots of support from the Education support helpline people here at NAS and that when we were having to go to tribunal to appeal against my son's exclusion, they offered us legal representation, which would have been free. fortunately the school backed down and we won, but they were very supportive and knowledgeable.

Give it a try - could be helpful.

    All the best!
