DLA tribunal win help needed!!!

Hi there I wonder if anyone has had any experience with what happens after a DLA tribunal appeal win?.

Sorry Bit of a lengthy one...

my son was diagnosed with autism in oct last year and I applied for DLA with the support of his speech and language therapist ( those forms are a nightmare). Anyway my son was awarded low rate care only even though he is still in nappies (age 4) and needs constant care and supervision throughout the day and night. I appealed and was refused on the basis that my son makes a conscience decision when he has difficulties when we are out due to his hypersensitivity etc. I asked for a tribunal appeal and was given a date of 28th October this year. I did as much research as I could and nervously represented myself at the hearing. The tribunal appeal which was heard by a judge, consultant and a lawyer was a success!!!

  • My son was awarded high rate care and mobility after i submitted a folder full of peads, occupational therapy, speech and language letters and reports as well as previous ASD DLA case studies. After leaving the appeal so happy after months of worrying , I received a letter from the DWP stating that they are applying to the court for a 'statement of reason ' and that they may appeal. I have not heard anything from them since this and have called on several occasions to just be told they are still waiting to hear back from the court. My worry is that they will appeal the tribunal decision and I will be back to square one. I've read that the DWP have a cetain amount of time to appeal to the upper tier level but if my hearing was back in October,  surely this time has passed?? Its unclear if the timeframe starts from the date of the hearing or when the paper work has been recieved?? Sorry for the rambling but would be really grateful if anyone could offer any advice.
