Medical Report

Hi. I am hoping someone might be able to help me. I have an employment tribunal looming and my former employer is arguing that I am not disabled. I am autistic, have adhd, joint issues and ocd - all of which I believe are relatively common in autistic people.
I have been advised to get a medical report or statement that confirms each of the conditions is linked to autism. My GP doesn’t seem to know much about autism, so I was wondering if I could ask another professional? I haven’t got a clue who to ask. It’s all extremely stressful.

  • Thank you so much for taking the time to reply. Yes I have an official diagnosis for autism and adhd… so I think I will go back to the psychologist who assessed me.

I sincerely appreciate your thoughts. They are very helpful.

  • Do you have an official diagnosis or are self diagnosed (for both autism and ADHD?

We are not allowed to offer legal advice or medical advice by the forum overlords so I can only say what I would do in your situation.

1 - I would join ACAS and ask them for advice.

2 - I would speak to my doctor and say I need an urgent referral to an autism specialist to corroborate my link with the symptoms mentioned. I would tell him it is urgent as my job depends on it.

3 - I would try to find a psychologist with a specialism in autism and arrange a session with them ASAP to clarify my concerns (since I doubt the GP could arrange a pee up in a brewery). Point out that it may be needed for an employment tribunal so I would already manage their expectations of an output from the meeting.

You can find loads from the site https://www.psychologytoday.com/gb/counselling/england then click on the ALL FILTERS button on the top right and check autism and any other conditions you want them to be knowledgable in.

4 - I would ask the company if this would be accepted (from a degree qualified psychotherapist) as their standard of medical proof.

5 - I would also look for a emplyment solicitor in my area and pay for an initial consult with them to understand my rights and the possibe paths this could take. It should help manage my anxiety better by having a better handle on possible outcomes. It will cost more than £100 but in my opinion it is worth it to have them on speed dial.

6 - I would ask the company for the full details of their policy on the tribunal as there are some details where they will actually pay for the solicitor of the medical reports in many cases - if nothing else I would at least know more about the parameters of what they can and cannot do.

7 - I would then play hardball, passing all communication by my solicitor and pointing this out to them so they know they will be under microscopic scrutiny and dare not make a mistake.

8 - lastly and sadly, I would update my CV and get job hunting. In the vast majority of cases I have seen in my long career, once it reaches tribunal then your card is marked and they will find way to make you want to leave. It is just my experience but I have seen it dozens of times and only once seen a happy outcome (following a major management change that was unrelated to the case).

I hope my thoughts may offer some ideas for consideration.
