Autism support at Employment Tribunal

To the point - could I accompany my son at an Employment Tribunal ?

He has never been diagnosed as autistic, but displays many of the characteristics that my daughter does, and she was identified with high functioning autism at school.

My 31 year old son is a fully qualified electrician, who is owed approx. £13,000 in wages. This has been built up over the last 3/4 yrs. Despite all of this he enjoys working for one man, as he doesn't get bullied, unlike his previous place.

However, the situation has finally got to him and he has asked me for my advice. On his own I don't think he would stand up well at a Tribunal as he goes out of his way to avoid confrontation.

  • he needs to build a case and notes and evidence, get a solicitor, run it through the solicitor first before you open a tribunal.... it may take time for them to look over everything and judge it.... if its a case he can win the solicitor will give advice of how to proceed, if its unwinnable or not a case or if theres any flaws in it then the solicitor will give advice based on that and decline it. 

    i thought i had a solid case but solicitors can point anything out that negates your case, to which they pointed out some bs that essentially negated my case and allowed my employer to brazenly get away with breaking the law. takes a solicitor to see what can undo your case though. but yeah it defo needs a proffesional law guy to look over his case but on your sons end he needs to gather everything every evidence every note and every point.

    I will be out for this employer personally - no payslips/holiday pay/sick pay/P60. He's really played on my son's character and it really is unfair.

  • My one concern is that the self employed employer (a one man band), who runs his business as a limited company, will declare the business bankrupt. Obviously we'll need specialist knowledge on this subject.

    But I really feel my son has been played. I could say more but that would only p*** me off more that I already am. Rolling eyes

  • yeah you have em then, theres no excuse for not having pay slips its a requirement to provide them by law. not sure theres any defence for it unless they turn around and claim its online or on a app that he can access
