Was my daughter not paid because she is autistic?

We have been asking a large organisation for my daughter’s pay since March 2022.

They did not respond to any form of communication. So we took them to small claims court. They did not respond and are now due to go  county court in June. 
Can they also be taken to court for discrimination? If so does anyone how I go about this? I can’t help but wonder if we would be having this battle if she was not autistic. 

  • We had a similar situation but didn’t go to the small claims court in the end. They claimed that the employee wasn’t really an employee yet, and were simply trialing the job….

  • Ghosting and stonewalling are often effective ways in society for 'shutting people down'. And major corporations would rather deal with lawsuits which come out of an insurance claim than deal with complaints against them. 

    Make sure to gather all evidence whether it's the transport she took to go there and who she reported to. Detail any emails or signed documents or any materials and combination from the company for the dates she was scheduled to work. Discrimination can be hard to prove, but if you can, then yes. 

  • I don’t know but being autistic can make you more vulnerable to exploitation. I ended up working 6 months unpaid ... I am not saying someone else would not have ended up in similar situation (in fact I was not the only person this happened to there) but I tend to trust people and am not good at reading their intentions. This makes me more vulnerable. 
    I don’t know about the legal system so I can’t really answer any of your questions. I hope you get the justice you deserve. Was it just your daughter that wasn’t paid? Or others too?
