Delays with DWP

Hi folks!

I'm not sure if this is a unique experience or not, but here goes...

I had a terrible time with PIP - the assessment was abusive, almost accused of lying, etc.. the typical assessment. A couple of weeks later, I got the UC assessment which was a lot better.

The results were that with PIP, I had to go to court to get my points raised from zero. I got standard living and enhanced mobility.

With the UC, I was put into the LCW category. I was so drained after the PIP process that I didn't contest it. It was due to have been reviewed last March. In the year prior to that, I got 3 or 4 phone calls from the job center to see if anything had changed - that was the extent of communication from them.

My intention last year was to push for LCWRA. Then Covid hit so no forms were sent out. After the lockdown, I kept on at them to send the forms for the assessment. I got them and sent them back in September last year.

Since then, I've heard nothing. I had to ring twice to get them to acknowledge they had received the forms. I've tried a couple of times to get an update and just get told they will contact me if they need anything else.

So, here I am now, over a year since I was supposed to be re-assessed, and almost 7 months since they received the forms back. Is there a legal route I can take to force them into a decision?

  • I thought I'd update on this...

I was eventually sent an appointment for a Sunday, so I was unable to arrange support and had to cancel the appointment, as travelling is extremely difficult at the best of times (I get full mobility PIP because of the difficulties). Travelling alone is impossible due to shutdowns.

Another appointment arrived for a morning phone call - despite my forms saying I am non-functional in mornings. However, I did manage to get someone to support me for the phone call.

On the day, I got the call, went through the security checks, and was then told there would be no assessment, and it would be re-arranged. Because sudden change is really good with autism. (Sarcasm).

That was 2 months ago, and so far, nothing. So as it is now, it's 11 months since the forms were returned, and 16 months since I was supposed to get the re-assessment.
